Terms of Service

These Terms of Service govern your use of the Kestrel Mail macOS application and website. By downloading, installing, or using Kestrel Mail, you agree to these terms. If you do not agree, do not use the application.

Eligibility

You must be at least 13 years old to use Kestrel Mail. If you have not reached the age of majority where you live, you may use the application only with permission from a parent or legal guardian.

License to use Kestrel Mail

Subject to these terms, Kestrel Mail grants you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use the application on Macs you own or control.

You may not sell, sublicense, rent, or distribute the application, or attempt to bypass its security features, except where applicable law expressly permits it. Third-party and open-source components remain subject to their respective licenses.

Your email accounts

You may connect only email accounts that you own or are authorized to access. You are responsible for maintaining the security of your Mac, account credentials, and mail-provider accounts.

Kestrel Mail communicates directly with your mail providers. Actions you take in the application, including sending, moving, archiving, or deleting messages, may be synchronized to those providers and other devices. You are responsible for reviewing actions before confirming them and for maintaining any backups you need.

Acceptable use

You agree not to use Kestrel Mail to:

  • Access an account or data without authorization.
  • Violate applicable law or another person's rights.
  • Send spam, malware, or other harmful or deceptive content.
  • Interfere with Kestrel Mail, a mail provider, or another service.
  • Circumvent security, authentication, or usage restrictions.

Privacy

Kestrel Mail processes email locally and communicates directly with your chosen mail providers. Our Privacy Policy explains what data the application handles, where it is stored, and which services it contacts.

Third-party services

Kestrel Mail depends on services operated by third parties, including your email provider, Apple, Google, and Microsoft. Your use of those services is governed by their own terms and policies. We do not control their availability, security requirements, account restrictions, or service changes.

AI-generated summaries

Kestrel Mail may offer optional, on-device summaries generated by local language models. Generated summaries can be incomplete or inaccurate. They are provided for convenience and should not replace reviewing the original message, especially when making legal, financial, medical, safety, or other important decisions.

Beta software

Pre-release versions of Kestrel Mail may contain errors, change without notice, or fail to operate as expected. Features may be added, removed, or modified before a public release. Use beta builds with appropriate caution, particularly with important email accounts and data.

Availability and changes

We may update, suspend, or discontinue all or part of Kestrel Mail at any time. We may also limit or end access when these terms are violated. You may stop using the application at any time by removing it from your devices.

Disclaimer of warranties

To the maximum extent permitted by law, Kestrel Mail is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We do not warrant that the application will always be secure, uninterrupted, error-free, or compatible with every mail provider or account configuration.

Limitation of liability

To the maximum extent permitted by law, Kestrel Mail and its developer will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost messages, data, profits, business, or opportunities arising from your use of the application. Our total liability for any claim related to Kestrel Mail will not exceed the greater of the amount you paid for the application during the 12 months before the claim or 50 US dollars.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so parts of these sections may not apply to you.

Governing law

These terms are governed by the laws of the State of Colorado, excluding its conflict-of-law rules. Any dispute that is not subject to a different forum under applicable consumer law will be resolved in the state or federal courts located in Colorado.

Changes to these terms

We may update these terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of Kestrel Mail after the updated terms take effect means that you accept them.
